NewCold Coöperatief UA and its subsidiaries (collectively: "NewCold" or "we") have drawn up this privacy statement to demonstrate our commitment to individuals' rights to data protection and privacy.

This privacy statement applies to the processing of personal data in the course of our worldwide business activities, including via our website www.newcold.com. In it you will find information about the categories of personal data we collect, why we collect it, how we use it, how we protect it and your rights.

NewCold is considered the "controller" within the meaning of the General Data Protection Regulation ("GDPR"). This statement explains generally how we comply with data protection laws and regulations, including the European GDPR, national laws implementing it, as well as applicable data protection laws in the United States, Australia and other jurisdictions.

Collection and processing of your personal data

We process the personal data of our customers, suppliers, relations, students, applicants and visitors to our websites. This data can be obtained :

Purposes of personal data processing

We process your personal data for one or more of the following purposes (depending on our relationship with you):

Marketing and acquisition
We use your personal data to send newsletters, event invitations and other marketing communications that may be of interest to you, as well as in connection with (registering for) one of our marketing events. After an event, we may also contact you for feedback.

Fulfilment of a contract
We process your personal data as necessary in connection with the products or services we provide, including the exchange of data for quotations, the execution and completion (including invoicing) of an order, a request for service or a contract.

Compliance with legal obligations
We process your personal data to comply with legal obligations, such as collecting and storing data and providing information to tax and supervisory authorities.

Recruitment
The data you share with us when applying for a job (by e-mail/post, via the application form on our website or via social networks) or that we receive through recruiters is processed to contact you as part of our recruitment procedures. We also process your data in connection with (registration for) an internship with one of our subsidiaries.

Access control and security
For security reasons (e.g. emergency evacuation), we keep a list of visitors to our sites. These lists are destroyed at the end of the day. We also use video surveillance to protect the property and safety of our employees and visitors. For further information on CCTV, please refer to our CCTV policy, which is available from the reception desk at each site and applies to all NewCold sites.

Improving our website
We process statistical data about your visit to and use of our website in order to analyze and improve the content, layout and usefulness of our website.

Other processing
We may also process your data as part of customer satisfaction surveys or to deal with queries or complaints.

Sharing your personal data

NewCold companies, customers, suppliers and subcontractors; Channel partners and other service providers such as banks, insurers, bailiffs, accountants, tax advisors and other consultants; External suppliers such as IT service providers, hosting providers, cloud service providers or other suppliers to whom we outsource support services. If the third party with whom your personal data is shared is a processor within the meaning of the GDPR, we will also enter into a processing contract with that third party.

Retention of personal data

We store your personal data in accordance with applicable data protection legislation and specific legal retention periods. Data is kept for no longer than is necessary to achieve the purpose for which it was collected and to meet legal obligations.

You have the right to request access to, correction, deletion, limitation and portability of your personal data. You also have the right to object to the processing of your personal data. Please note that individuals' rights under the GDPR are subject to certain restrictions and are not always granted. A request may be partially or completely refused due to these restrictions, such as legal obligations, third-party rights and NewCold's legitimate interests. If we are unable to comply with a request, we will inform you and explain the reasons.

However, withdrawing your consent does not affect the lawfulness of the processing based on consent prior to its withdrawal. Transfer of personal data outside the EEA

Any information you provide via our websites is stored on servers located in the European Economic Area (EEA). If necessary, we may share information with our affiliated companies inside and outside the EEA.
